Who has priority in the printer?

  • Step 2. State the general rule: as between perfected security interests, priority goes to the first to register or otherwise perfect.
  • Step 3. State the exception: a purchase-money security interest in equipment takes priority over an earlier general registration only if it is perfected within the short statutory window after the debtor obtains possession, which the applicable provincial personal property security statute sets.
  • Step 4. Apply: Northline financed the acquisition of the very collateral, so its interest qualifies as a purchase-money security interest, but possession passed on March 3 and registration came seventeen days later.
